Law “On Concessions” no. 9663, dated 18.12.2006 amended by Law No. 9995, dated 22.9.2008, published in the Official Gazette no. 156 dated 10 October 2008. Amendments introduced included the possibility of the execution of concession agreements involving investments of value of less than 20 million EUR without the need for the approval of the Council of Ministers. More interestingly the changes now permit the recognition of step-in rights, enabling the contracting authority to substitute the concessionaire upon its serious infringement of the concession and where financing institutions require such (on the basis of a step-in right). For information on other amendments you may review the newsletter of January 2009 to be found here.
